A Comissão Europeia publicou recentemente a Lei de Dados (e o Regulamento sobre Circuitos Integrados - "Chips Act"), deixando-a aberta para consulta pública até 9 de maio de 2022.

Essa iniciativa, conhecida como a 'Lei de Dados', visa facilitar o acesso e o uso de dados, incluindo "business-to-business" e "business-to-government", e revisar as regras sobre a proteção legal de bases de dados. Ela busca o equilíbrio correto entre os direitos ao acesso aos dados e os incentivos a investir em dados, sem alterar as atuais regras de proteção de dados.

Todes que tiverem interesse em escrever uma sugestão estão convidades para se juntar à declaração do MyData!

Data Act published for public consultation

The Commission has now published the Data Act (and the Chips Act) for public consultation - Deadline is 9 May 2022.

This initiative, known as the ‘Data Act’, aims to facilitate access to and use of data, including business-to business and business-to-government, and to review the rules on the legal protection of databases. It seeks the right balance between rights to access data and incentives to invest in data, without changing the current data protection rules.

Theorising Personal Data Markets in the Age of Communicative Capitalism

In this article, we focus on the increasingly popular market-libertarian critique that proposes individual control, ownership, and ability to commodify one’s personal data as an answer to corporate data extraction, derivation and exploitation schemes. We critique the claims that personal data markets counterbalance corporate digital capitalism on two grounds. First, these markets do not work economically and therefore are unable to address the exploitative aspect of surveillance capitalism. Second, the notion of personal data markets functions ideologically because it reduces the critique of surveillance capitalism to the exploitation of consumers and conceals the real objective of data capitalists such as Google, Facebook, Amazon and Apple to not (just) exploit audiences but to create worlds that create audiences.

EUの司法裁判所(CJEU)は、米国が同国の国家安全保障局(NAS)の監視から米国企業が有する自国民以外の情報を保護していない、としてEUと米国の間のデータ共有に関する枠組み「プライバシーシールド」を無効にしました。Facebookなどの米国企業は、EEA域外へのパーソナルデータの移転を特別に認めるGDPR(一般データ保護規則)の標準的契約条項(SCC:Standard contractual clauses)を締結できなくなります。併せて、EU司法裁判所は、GDPRの適用を行うべき欧州委員会および、アイルランドのデータ保護委員会(Irish Data Protection Commission)などにGDPRを形骸化させないようにその責務を果たすよう求めています。

The Global Observatory of Urban AI, the CC4DR’s initiative to guide the ethical implementation of AI in cities, is currently building a repository of AI Projects from cities all around the world, that will be made available for consultation via an online ATLAS. This crowdsourced repository of projects aims to recognise the efforts of automatisation and digitalisation in cities, and become a focus point for researchers, local policymakers, and the public interested in AI.

We are currently gathering the projects that will feed the Atlas, and that is why we would like to ask you to fill this form with your local projects.
